1. Purpose
The Archive exists for historical preservation and documentation of materials related to Monroeville Mall.
2. Submission Moderation Disclaimer
All submissions are subject to review, modification, rejection, or removal at administrator discretion. Approval does not imply endorsement or verification of accuracy.
3. Contributor Attribution Policy
Where applicable, contributors will be credited by username. Contributors grant permission for attribution display. We reserve the right to format or standardize attribution.
4. Archival Preservation Rights
By submitting content, you grant the Archive a perpetual, irrevocable, non-exclusive, worldwide license to:
- Display and publish the content
- Store and archive indefinitely
- Create backups and preservation copies
- Format-shift for technical compatibility
- Distribute for historical reference
5. Historical Accuracy Disclaimer
Content is provided for historical and informational purposes. The Archive makes no guarantees regarding accuracy, completeness, or reliability. Users should independently verify historical claims.
6. User Conduct
- No unlawful uploads
- No impersonation
- No malicious activity
- No infringement of third-party rights
7. Intellectual Property
Platform design and original materials are protected. Third-party content remains property of respective owners.
8. Disclaimer of Warranties
The Archive is provided "as is" and "as available" without warranties of any kind.
9. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for indirect, incidental, consequential, or punitive damages.
10. Indemnification
You agree to indemnify and hold harmless the Archive from claims arising from your submissions or conduct.
11. Copyright Complaint Procedure
Claims of copyright infringement will be handled in accordance with the complaint process described in our Privacy Policy.
12. Termination
We reserve the right to suspend or terminate access at our discretion.
13. Governing Law and Jurisdiction
These Terms and any disputes arising out of or relating to the Archive shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to conflict of law principles.
You agree that any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located within the Commonwealth of Kentucky, and you consent to personal jurisdiction and venue therein.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
15. Entire Agreement
These Terms constitute the entire agreement between you and the Archive regarding use of the platform and supersede any prior agreements.
